This article will discuss factors in a motorcycle accident insurance claim and the necessary documentation required to ensure a successful claim. It is important to realize that the factors in a successful motorcycle accident case are basically in-line with the same factors that would come into play in any auto accident case. In order for motorcycle accident injury plaintiffs to be successful in their claim it is necessary for them to prove that the defendant driver’s carelessness, inattentiveness or recklessness directly caused the rider’s injury. However, it should be noted that the laws affecting motorcycle accident injuries vary from one state to the next. The following factors are necessary in order to have a successful motorcycle accident insurance:

  • Availability of adequate insurance - one of the most important keys to a successful motorcycle accident injury case is having the correct insurance policy for you and your motorcycle. Generally, motorcycle insurance is very specific when it comes to the type of coverage as well as the state laws with regard to motorcycle insurance requirements. However, such state laws vary from one state to the next. In most states, a rider who does not have the appropriate coverage will be limited with regards to the options available after an accident occurs. This is especially so when there is no one else to hold legally liable for the accident or the at fault driver has no insurance and nothing in the way of assets. This could result in the motorcycle rider having to pay for his or her own medical bills, repair bills and other losses if their insurance coverage is limited.
  • Documentation of the accident - if a rider is physically able he or she must collect as much information as possible after the motorcycle accident occurs. However, the rider’s first priority must be to get medical attention if he or she has suffered injuries. When possible, the rider must take photographs of the scene of the accident from as many angles as possible, gather witness names and contact information. Where a rider is unable to gather the information, he or she may try and enlist someone at the scene to do it for them. In addition, where appropriate the rider must notify police which allows for the gathering of information with regards to witnesses and statements. One article states that, “do not hesitate to call the police even if you may have been at fault for the accident. Fault and liability do not always go hand in hand. Further, by contacting the police you are creating a record that is as near in time to the actual incident as possible”.
  • Medical attention and records - as soon as possible after your motorcycle accident seek medical attention. By doing so you create a paper trail in the form of medical records.
