Accidents happen unexpectedly, and when they do, both parties both the victim and the person who caused the accident may suffer psychological and physical injuries. In some cases, lives are lost and vehicles totalled. But what’s worse is many people often go without any form of compensation. No one wants an accident to happen; that’s why they are called accidents – they happen without warning. However, that shouldn’t mean that those who are involved in the accident should just wake up, wipe off the dust and move on. Car accident victims have legal rights to get compensated for their loss, and that includes everything from their medical expenses, lost wages, or any other cost that they incur as a result of the accident. If you are involved in an accident, whether due to the negligence of another person, you have the legal right to be compensated. Here are some reliefs that a court may grant you following a car accident: Declaration of rights of the injured party The declaration of rights is where the court rules out that the rights of the accident victim have been violated. Order of compensation The order of compensation may either be for either special damages or general damages. Special damages is the monetary compensation that the accident victim receives for the known costs that arise from their injuries. This may include loss of income, hospital bills and loss of future income. If fully convinced, the court will make a judgment in favor of the victim to get the compensation. General damages, on the other hand, are the reasonable amount of compensation that the victim receives as a result of the pain or physiological injuries, whose value is often unknown. Other orders The court may offer an injunction, where the court prohibits the perpetrator’s vehicle from being driven on the roads until the final verdict regarding the case has been made. This restricts the driver from getting out of the court’s jurisdiction, or from running away. An injunction may be temporary or permanent in nature. The right to be compensated As an accident victim, you have the right to be compensated in full. But remember, you should leave nothing to chance. After an accident, the only important thing that you can do, other than seeking legal help, is going to the hospital.
